Wardler – Clearance Items Policy (United States)

All items marked as “Clearance,” “Final Sale,” “Closeout,” or “Last Chance” are sold as FINAL SALE.
Clearance items are:
• Not eligible for return
• Not eligible for exchange
• Not eligible for store credit
• Not eligible for price adjustments
Except as required by applicable U.S. law, all sales of clearance items are final.

If you receive:
• A defective product (manufacturing defect only), or
• An incorrect item due to Wardler’s fulfillment error
You must notify us within 5 calendar days of delivery at sales@wardler.com with:
• Order number
• Clear photos of the issue
• Description of the defect
Upon verification, Wardler may, at its sole discretion:
• Replace the item (if available), or
• Issue a refund to the original payment method
Normal wear and tear, improper use, crash damage, sizing issues, or cosmetic preferences do not qualify as defects.

Clearance products are offered in limited quantities and may be discontinued models.
In the event of inventory discrepancies or overselling, Wardler reserves the right to:
• Cancel the affected order and issue a full refund, or
• Offer a comparable replacement (subject to customer approval)

Unless otherwise stated:
• All clearance items are new and unused
• Items may be discontinued styles, prior production runs, or overstock
• Packaging may show minor cosmetic imperfections
Such packaging conditions do not constitute product defects.

Clearance items are covered under Wardler’s limited manufacturing defect warranty only, unless otherwise specified on the product page.
TO THE MAXIMUM EXTENT PERMITTED BY U.S. LAW:
WARDLER DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
No warranty coverage applies to:
• Crash damage
• Improper use or modification
• Normal wear and tear
• Incorrect sizing selection

Customers are solely responsible for selecting the correct size based on the Wardler size guide.
Clearance items cannot be exchanged due to incorrect sizing selection.

Clearance pricing cannot be combined with additional promotional codes, discounts, or special offers unless expressly stated.

By purchasing a clearance item, you agree that initiating a chargeback in violation of this Final Sale policy constitutes a breach of these terms.
Wardler reserves the right to dispute improper chargebacks and submit this policy as evidence to the payment processor.

To the maximum extent permitted by law, Wardler shall not be liable for any indirect, incidental, special, or consequential damages arising from the purchase or use of clearance items.
Wardler’s total liability shall not exceed the purchase price paid for the product.

This policy and all clearance purchases made by U.S. customers shall be governed by and construed in accordance with the laws of the State of [Insert Preferred State – e.g., Delaware or California], without regard to conflict of law principles.

By completing a purchase of a clearance item, you acknowledge that you have read, understood, and agreed to this Clearance Policy.
